I just did the following steps:
$ sudo sbuild-createchroot unstable /srv/chroot/unstable-amd64 http://httpredir.debian.org/debian
then added "union-type=overlay" to /etc/schroot/chroot.d/squeeze-amd64-sbuild-XXXX
And then tried to build a package. This went through without any errors.
So are you sure that there is still a chown call missing?
