We build `cgminer` with generic "ocl-icd-opencl-dev | opencl-dev" that
do not directly depend on proprietary opencl. As we don't have Mesa
with opencl yet I have no proof that cgminer can't use free opencl.
Even if that's the case it may be considered as bug rather than
deliberate design choice.

If `cgminer` can't use free opencl I'd vote for its removal and
replacing with `bfgminer`. It remain to be seen how well both miners
will work with free opencl.
