[pkg-mad-maintainers] MP3 decoding patent issues?

I have heard many other distributions (such as Ubuntu) either exclude libmad
(and related gstreamer/xine/etc packages) or put it in a special repository
due to the infamous MP3 patent issues.  Out of curiousity, how did Debian
end up including it in main?  Does it have a different policy than most
other distributions with regard to patent issues, or is it somehow exempt
from these issues due to being non-commercial?
Just curious...
