Yes, Nomachine may do that.

In this way, nobody can make a NX-server what does not have a
GPL2-license with this libraries. Only Nomachine can.

I think the way to distribute it is with duplicated code or to rewrite
the protocol changes in a way they are acceptable for X.org.

I expect the last way is much work.
