1.2.1 says that only a user may download the software
1.2.1.1 says that you may do only one backup copy of the software
5.3 mentions TPM

The word "distribute" does not appear in the license, so distribution is 
not allowed.

Choosing a DFSG compatible license would be the best way to go ...
